🚗 Libicar Terms of Service

Welcome to Libicar.
By accessing or using our website (www.libicarauto.com) and our car rental services, you agree to comply with and be bound by the following Terms of Service (“Terms”). Please read them carefully before making a booking or using any part of our service.

If you do not agree to these Terms, please refrain from using our website or services.


1. Definitions

  • “Company”, “we”, “our”, or “us” refers to Libicar.
  • “Customer”, “you”, or “your” refers to any individual or entity renting a vehicle or using Libicar’s services.
  • “Vehicle” refers to any car or automobile rented or provided under this agreement.
  • “Rental Agreement” refers to the contract entered between Libicar and the customer upon confirmation of booking.

2. Use of Our Services

By using Libicar’s services, you represent that:

  • You are at least 21 years old and hold a valid driving license.
  • You have the legal authority to enter into a binding contract.
  • All information you provide is true, complete, and accurate.
  • You agree to comply with all traffic laws, safety regulations, and rental conditions throughout the rental period.

Libicar reserves the right to decline or cancel any booking at its discretion if fraudulent, incomplete, or suspicious activity is detected.


3. Booking and Payment

  • All bookings are subject to vehicle availability and payment confirmation.
  • Rental charges include only what is specified in your booking (e.g., base rental fee, insurance coverage).
  • Additional costs such as fuel, tolls, parking fees, late returns, or damage charges are borne by the renter.
  • A refundable security deposit is required for all rentals. The amount may vary by vehicle type.
  • Payments can be made through credit/debit card, online transfer, or approved payment gateways.

4. Security Deposit and Returns

  • A security deposit is collected before pickup and will be fully refunded within 3–5 working days after vehicle return, provided:
    • The car is returned in its original condition.
    • There are no outstanding fines, damage, or missing accessories.
  • Libicar reserves the right to deduct repair costs or administrative charges from the deposit where applicable.

5. Cancellations and Refunds

Our Refund & Returns Policy applies to all cancellations.
Customers may be eligible for full, partial, or no refund depending on the notice period before rental start date.

6. Vehicle Pickup and Return

  • The customer must inspect the vehicle before pickup and report any existing damage immediately.
  • The vehicle must be returned on or before the agreed time and location.
  • Late returns will incur additional hourly or daily charges.
  • Early returns do not qualify for refund unless stated in the Refund Policy.
  • The customer is responsible for ensuring the fuel level matches the level noted at handover.

7. Vehicle Use and Responsibility

During the rental period, the customer agrees to:

  • Operate the vehicle responsibly and lawfully.
  • Not use the vehicle for:
    • Racing, towing, off-road driving, or illegal activities.
    • Transporting hazardous goods or animals (unless authorized).
    • Driving under the influence of drugs or alcohol.
  • Only authorized drivers listed in the rental agreement may operate the vehicle.

The renter is fully liable for:

  • Any damage, loss, or third-party claims arising during the rental period.
  • Traffic summonses, speeding fines, parking tickets, or toll violations.

8. Insurance and Liability

  • All Libicar vehicles come with basic insurance coverage as per local law.
  • Insurance coverage may exclude reckless or negligent driving, racing, or DUI cases.
  • The renter may opt for additional coverage at the time of booking for extended protection.
  • The customer is liable for any insurance excess or deductible in the event of a claim.

9. Vehicle Breakdown or Accident

  • In the event of an accident or mechanical issue:
    • Contact Libicar Customer Support immediately at 019-981 0206.
    • Do not abandon the vehicle or authorize third-party repairs without Libicar’s approval.
  • For accidents:
    • File a police report within 24 hours.
    • Submit all supporting documents for insurance claims.

Failure to follow these steps may result in loss of insurance coverage and full liability for damages.


10. Modification or Termination of Service

Libicar reserves the right to:

  • Modify or discontinue any part of the service at any time without prior notice.
  • Refuse, cancel, or terminate any rental agreement if misuse or fraud is detected.
  • Update pricing, policies, or terms periodically to reflect operational needs or legal compliance.

11. Limitation of Liability

Libicar shall not be liable for:

  • Any indirect, incidental, or consequential loss (e.g., loss of income, missed flights, etc.).
  • Delays due to traffic, breakdown, or unforeseen circumstances beyond our control.
  • Personal belongings left inside the vehicle.

Our total liability shall not exceed the amount paid for the rental.


12. Privacy and Data Protection

We respect your privacy.
All personal data collected during booking and rental processes are handled in accordance with our Privacy Policy.
Your data will not be sold or shared with third parties except as required by law or necessary for service delivery.


13. Governing Law

These Terms are governed by and construed in accordance with the laws of Malaysia.
Any disputes arising shall be subject to the exclusive jurisdiction of the courts of Malaysia.
